SETTLEMENT UPDATE November 23, 2009:
On September 10, 2009, the Court issued an opinion indicating that it will not approve
the Settlement Agreements, based on a lack of subject matter jurisdiction. The Court
did not decide whether the Settlement Agreements are fair or in the best interests
of Class Members. Counsel for plaintiffs and the class have filed motions to amend
the Court’s opinion. Counsel for plaintiffs and counsel for defendants are engaged
in discussions regarding the future of the litigation.
If You Are a Current or Prior Owner of Land Next to or Under Railroad Rights of
Way in Which Fiber-Optic Cable is Installed, You May Be Able to Qualify for Payment
From a Proposed Class Action Settlement.
A Proposed Settlement has been reached between certain Defendant Telecommunications
Companies and a proposed Class of current and prior owners of land next to or under
certain railroad Rights of Way. It resolves litigation over whether these Defendants
had the right to install Telecommunications Facilities within railroad Rights of
Way without the consent of members of the Proposed Settlement Class.
The Defendants are Sprint Nextel Corporation and Sprint Communications Company,
L.P.; Qwest Communications Corporation; Level 3 Communications, Inc. and Level 3
Telecom Holdings, Inc.; and WilTel Communications, Inc., WilTel Communications,
LLC and Williams Communications, LLC f/k/a Vyvx, Inc. This settlement includes fiber-optic
cable in the District of Columbia and forty-six of the lower forty-eight states.
This settlement does not include fiber-optic cable in Louisiana or Tennessee.
Under the Proposed Settlement, current or prior owners of land next to or under
railroad Rights of Way in which the Defendants have installed Telecommunications
Facilities may make claims for payment. If you make a Qualifying Claim, you may
be able to receive payment. Procedures for filing Qualifying Claims are explained
in the Notice for your state and detailed more fully in the Proposed Settlement
Agreement.
